Terms of Service

These Terms of Service (“Terms”) govern your use of nxs.management (the “Site”), operated by NXS Management, LLC (“NXS,” “we,” or “us”). By accessing the Site or submitting an inquiry through it, you agree to these Terms. If you do not agree, do not use the Site.

1. Services

NXS provides talent management services, including creator representation and the facilitation of brand partnerships, in regulated and high-trust verticals. The Site is informational and provides intake forms for prospective creators and brands to inquire about working with us.

2. No representation or counsel relationship

Visiting the Site, sending an inquiry, or otherwise communicating through the Site does not by itself create a management, agency, fiduciary, or legal-counsel relationship between you and NXS. Any management or representation relationship is established only by a separate, signed written agreement.

Information on the Site is provided for general informational purposes only and is not legal, financial, medical, tax, or compliance advice. You should consult qualified professionals for advice specific to your situation.

3. Eligibility and accurate information

You must be at least 18 years old to submit an inquiry through the Site. You agree to provide accurate, current, and complete information in any intake form and to update that information if it changes.

4. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose.
  • Attempt to gain unauthorized access to any portion of the Site, our systems, or any related networks.
  • Interfere with or disrupt the operation of the Site, including by submitting spam, malware, or fraudulent inquiries.
  • Misrepresent your identity, affiliation, or audience.
  • Scrape, copy, or reuse content from the Site without our prior written permission.

5. Intellectual property

The Site and its content — including text, graphics, logos, the NXS Management name and mark, and the layout and design — are owned by or licensed to NXS and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to view the Site for personal or business-evaluation purposes. All other rights are reserved.

6. Third-party links and services

The Site may contain links to third-party websites or use third-party services (such as a form-submission processor or hosting provider). We are not responsible for the content, policies, or practices of any third party. Your use of any third-party site or service is at your own risk and subject to that third party’s terms.

7. Disclaimer of warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NXS, ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY INQUIRY SUBMITTED THROUGH IT, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless NXS and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your breach of these Terms, or your violation of any law or third-party right.

10. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

11. Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when they were last revised. Continued use of the Site after a change constitutes acceptance of the updated Terms.
